WorldNetDaily reports on an imminent United Nations’ assault on parental rights with Michael Farris, president of, chairman of the Home School Legal Defense Association and chancellor of Patrick Henry College weighed in.

The item of concern is the U.N. Convention on the Rights of the Child:

He told WND that under the U.N. Convention on the Rights of the Child, or CRC, every decision a parent makes can be reviewed by the government to determine whether it is in the child’s best interest.

“It’s definitely on our doorstep,” he said. “The left wants to make the Obama-Clinton era permanent. Treaties are a way to make it as permanent as stuff gets. It is very difficult to extract yourself from a treaty once you begin it. If they can put all of their left-wing socialist policies into treaty form, we’re stuck with it even if they lose the next election.”

The 1990s-era document was ratified quickly by 193 nations worldwide, but not the United States or Somalia. In Somalia, there was then no recognized government to do the formal recognition, and in the United States there’s been opposition to its power. Countries that ratify the treaty are bound to it by international law.

Although signed by Madeleine Albright, U.S. ambassador to the U.N., on Feb. 16, 1995, the U.S. Senate never ratified the treaty, largely because of conservatives’ efforts to point out it would create that list of rights which primarily would be enforced against parents.

According to the Parental Rights Website, the substance of the CRC dictates the following:

  • Parents would no longer be able to administer reasonable spankings to their children.
  • A murderer aged 17 years, 11 months and 29 days at the time of his crime could no longer be sentenced to life in prison.
  • Children would have the ability to choose their own religion while parents would only have the authority to give their children advice about religion.
  • The best interest of the child principle would give the government the ability to override every decision made by every parent if a government worker disagreed with the parent’s decision.
  • A child’s “right to be heard” would allow him (or her) to seek governmental review of every parental decision with which the child disagreed.
  • According to existing interpretation, it would be illegal for a nation to spend more on national defense than it does on children’s welfare.
  • Children would acquire a legally enforceable right to leisure.
  • Teaching children about Christianity in schools has been held to be out of compliance with the CRC.
  • Allowing parents to opt their children out of sex education has been held to be out of compliance with the CRC.
  • Children would have the right to reproductive health information and services, including abortions, without parental knowledge or consent.

This will likely be ratified during the Obama administration.

At a Walden University presidential debate last October, Obama indicated he may take action.

“It’s embarrassing to find ourselves in the company of Somalia, a lawless land,” Obama said. “I will review this and other treaties to ensure the United States resumes its global leadership in human rights.”

Secretary of State Hillary Clinton has been a strong supporter of the CRC, and she now has direct control over the treaty’s submission to the Senate for ratification. The process requires a two-thirds vote.

Farris said Barbara Boxer, D-Calif., claimed in a private meeting just before Christmas that the treaty would be ratified within two years.

This treaty concerns me on several levels:

  • As an American – we lose our sovereignty.  I believe that international law only belongs in the venue of maritime law & treaties, policing genocide and war crimes.  Instances where a multi-national body needs to intervene.  This is not one of those instances.
  • As a Christian parent, what right does the government have in the discipleship process that goes on in my home.
  • As a parent.  I have the right to discipline (within reason) and educate my children as I see fit.
  • I am also disturbed by the pro-abortion and reproductive health agenda where again parental authority is usurped by the State, worse yet, mandated by an international body who was not elected.
  • Right to leisure?  So what the state is going to set up my kids chore schedule too?

Can you see why this would be a bad bill?  We need to be ready when this comes up to be ratified.

  2. I hope you are right. I'd have to look to see when they've declared treaties to be unconstitutional. I'd prefer to see this stopped in the legislative process. I'd have to think there would be enough Blue Dog Democrats who would go against it to stop it from being ratified.

  4. BTW, the 9 crows have already cited International Law numerous times. Where it comes to “child's rights” in particular, you need to be aware of the Roper v. Simmons case. Of note in this case also is David Ogden's involvement (appointee for Deputy Attorney General).

    Also be sure to do your homework on Thomas Perrelli for Associate Attorney General, and Dawn Johnsen for Office of Legal Counsel. With Holder (scary) already there, he is obviously trying to politicize the Justice Department.

    But, oh yea, I'm going down a rabbit trail here from where I started, aren't I? 🙂

    This treaty shouldn't be ratified. If it doesn't carry any weight at all why would they even bother with it?

    Frankly I think the U.N. is pretty much worthless as an organization. It it ineffective in its original mandate and corrupt to the core.

I have no doubt there are, because there's no way that ratifying this would command even majority support in this country; the Senate GOP will stand firm in opposition, and Democratic senators like Blanche Lincoln, Ben Nelson, and Kent Conrad will want to keep their seats. Let Barbara Boxer push this–that might give Carly Fiorina enough ammunition to beat her in CA.

  8. This is very real and you need to pay attention. This apathetic attitude that these things won't come to pass is exactly what has gotten the US to the place it already is.

    People, please do your research b/c this treaty/convention has been adopted by all countries except for the US and maybe one more. But go read some of the nonsense things that are happening in other countries due to this convention. Like in Italy where suspicious birth names are reported and the state has the right to rename your child!!! This isn't really about rights of the child — it's about taking rights away from the parent and giving it to the state. Using the term “children” has become popular b/c everyone is for children, right?!? If you think Boxer, et al. won't stand for this, think again. It fits right into their agenda.

    BTW, Jimmy Carter was the one who started the UN Convention on the Rights of the Child, your very own UNITED STATES prez.

    I don't want to be inflammatory or an alarmist, but this is real and you should really take the time to understand this and act.

  9. The one saving grace may be that SCOTUS ruled recently that a ratified treaty does not itself constitute law — Congress still has to pass laws to enact aspects of the treaty at home.

  10. Shane let me give you an example which will illustrate why your post is so harmful to the cause of Jesus Christ.

    I grew up in an Evangelical Free Church. One day when I was a teenager the pastor stood up and told us about the danger of Madalyn Murray O'Hair and her efforts to shut down religious broadcasting. Good people in that church, and millions like them around the country, wrote their congressmen and the FCC, urging them not to allow O'Hair to shut down religious broadcasting.

    Just one problem – it wasn't true. O'Hair had made no such effort, yet good Christian folk all over the country were deceived when their own pastors failed to verify if what they were saying was true. She had a huge laugh, and never failed to speak of the dimwittedness and gullibility of Christians. Her ridicule, aided by well meaning but deceived pastors, made Christians look like yahoos. It was very harmful, imho, to the cause of Jesus Christ.

    Which brings me to your post. You indirectly raise the spectre of jack booted police coming to your door to haul you off to jail because you choose to spank your kids. It's not going to happen. No UN resolution ever has any force of law in the United States. For something to become law here, the Congress has to pass it, and the President has to sign it. If you had done just a minimal amount of research into our laws, you would know that.

    And this is where I have a problem with you. No you didn't lie, but you repeated a lie without taking a minimal amount of effort to verify its veracity. You're a leader, Shane, the Lord has set higher standards for you. You need to “test the Spriits” as the Scripture says – and you need to be careful NOT to repeat unfounded lies, so that well meaing Christians like Kim are not deceived.

    And a couple comments in closing. Yes I have two kids. And no, it has nothing to do with Obama – it has to do with men who are called to the ministry, and their absolute responsibility to always speak the truth. I think you failed in that responsibility today, not because of any effort to deceive people like Kim, but because you are too willing to believe without question any publication or person who claims to be a “conservative.”

    I know you do not know me from Adam but please accept this in the spirit with which it is meant. I hope that my words are seasoned with grace.

    WorldNet DOES hype many things, so unfortunately that puts them in the precarious situation of “crying wolf” — people are apt to ignore them when something legitimate comes along. On the other hand, I wonder what people said about those crazy OT prophets! 🙂

    You would be surprised at how Child Protection Services does come around to people's doors with unfounded claims. All it takes is a wacky busybody calling making any nonsense claim and by law CPS will come to your door. It doesn't have to be substantiated. You are guilty until you prove yourself innocent.

    As a member of the home education community, I can tell you that this happens with relative frequency on a monthly basis. Homeschool Legal Defense (of which I'm a member) publishes monthly all the cases they encounter and this is just on the cases they get involved in. It happens more than you know.

    The Supreme Court has already cited foreign and UN law. Stack the court with a few more liberal judges and they will use it to set precedence. David Ogden, nominee for Deputy Attorney General supports it (among numerous other problems he has). Obama seems to be trying to politicize the Justice Department.

    Now will any of these crazy things happen overnight? Probably not. And if they do they may be isolated cases for now. But what if you are on the receiving end? And what about your children or their children? It is what Margaret Thatcher called “relentless incrementalism.” If one looks at history, it is obvious this has taken place.

    So again, Iowa Guy, I hope that my words have been gracious and that you will seriously look into this for yourself, not at the immediate threat to you personally but what it means as to the direction of our country for our posterity. Please try to think generationally.

  12. I posted on this very thing. One should also note that the US, in fact, SIGNED the treaty. Fortunately its ratification was blocked in the Senate.

    Now we have a majority of Democrats in Congress and a president who wants the USA to become one with the world. If it comes back to a vote, can you guarantee it will not pass?

    And, if ratified, do you think those who voted yes won't jump into it with a furor to get laws passed supporting the treaty? It is just one more thing we,a s Americans, need to watch out for.

    I am an alarmist, for sure. Because everything my government is doing lately seriously alarms me.

  13. Hey Iowaguy – I e-mails and stories like the O'Hair urban legend drives me nuts too. I don't pass stuff like that along. I've actually, numerous times have corrected people via e-mail who forward stuff like that to me (including my own father).

    This isn't the case with this story. You don't like WorldNetDaily, ok this can been read about in other places. Like Kim has mentioned you have no idea what is already taking place without stuff like this.

    This simply isn't a lie. I said “could.” Also why do we need to ratify a treaty like this? Then if we ratify it, why wouldn't we enforce it? What would be the point of that.

    It's all around bad idea.
