Recently, the Alabama State Supreme Court ordered a halt to same-sex marriages in their state, standing behind Chief Justice Roy Moore, and ignoring the January ruling of a United States district judge. A compelling legal argument can be made that the state court was within its rights to do so, at least until the U.S. Supreme Court rules on the matter later this year. But at that time, we may well reach a crossroads: If the U.S. Supreme Court mandates a redefinition of marriage in all fifty states, we will have to decide if we are willing to completely surrender our governance to the judicial supremacy that Thomas Jefferson called the “despotism of an oligarchy”, or if we will resist it.
